CUSTOMER AGREEMENT

This Customer Agreement sets out the general terms governing the relationship between Kuntokeskus Säterinportti (“the Gym”) and its customers.

This Agreement is separate from the purchase of any membership or fitness product. Purchasing a membership is optional and is governed by the current Membership Terms and Conditions.

By accepting this Agreement, the customer confirms that they have read, understood and agreed to comply with both this Customer Agreement and the Membership Terms and Conditions whenever purchasing or using the Gym’s services.


1. Fitness Services

Kuntokeskus Säterinportti provides fitness and wellness services, the scope, content, prices and opening hours of which are published on the Gym’s website and other official marketing materials.

The Gym continuously develops its facilities and services. Equipment, group exercise classes, facilities, opening hours and other services may therefore change from time to time.

Temporary service interruptions resulting from maintenance, repairs, renovations or improvements do not entitle customers to compensation, refunds or price reductions.


2. Duration of the Customer Agreement

This Customer Agreement enters into force immediately upon acceptance, either electronically or in writing, and remains valid until terminated.

The Agreement remains valid regardless of whether the customer currently holds an active membership.

Customers who later purchase a new membership are not required to accept this Agreement again.

The customer may terminate this Customer Agreement by providing written notice by email or in person at the Gym’s reception. The notice period is one calendar month.

Kuntokeskus Säterinportti reserves the right to terminate this Agreement with immediate effect if the customer materially breaches these terms or fails to fulfil their payment obligations. In such cases, any fees already paid shall not be refunded.


3. Access Credentials

Customers are provided with a personal access key, access card and/or PIN code, depending on the Gym’s access system.

Access credentials are strictly personal and may never be shared, transferred or lent to another person.

Each customer must register their own entry every time they enter the Gym, even when arriving together with other members.

Lost access credentials must be reported immediately so that access rights can be deactivated.

Customers must not allow anyone without valid access rights to enter the premises. Guest visits are permitted only with prior approval from Kuntokeskus Säterinportti.

Violation of these rules may result in:

  • a contractual penalty of €200;
  • immediate termination of the customer’s membership and Customer Agreement; and
  • where appropriate, a report to the police.

4. Use of the Gym

Only customers with valid membership or other authorised access may use the Gym.

Customers must leave the premises before closing time. If a customer’s actions result in unnecessary security or alarm call-out costs, the customer shall be liable for those costs.

Customers may only use areas designated for Kuntokeskus Säterinportti and are not permitted to access other parts of the property without permission.


5. Online Services

Each customer receives personal login credentials for the Gym’s online services.

Customers are responsible for maintaining accurate personal and contact information and for keeping their login credentials secure.

Login credentials may not be shared with any other person.


6. Customer Register and CCTV

The Gym operates recorded CCTV surveillance for security, access control, crime prevention, protection of property and investigation of incidents.

Recordings are accessed only by authorised personnel whose duties require such access.

The Gym may store a photograph of the customer in its customer register for identification and access control purposes.

By accepting this Agreement, the customer consents to the use of CCTV in accordance with applicable legislation.


7. Customer Responsibility

Customers participate in all activities entirely at their own risk.

Each customer is responsible for ensuring that they are medically fit to participate in exercise and physical activity.

Kuntokeskus Säterinportti accepts no liability for injuries, accidents, illnesses or other health-related issues arising from the customer’s use of the facilities or participation in activities.

Customers who intentionally or through gross negligence damage the Gym’s property shall be liable for all resulting repair or replacement costs.


8. House Rules

Customers must always comply with the Gym’s House Rules and any instructions given by members of staff.

The Gym reserves the right to remove a customer from the premises or terminate their membership if their behaviour compromises safety, disrupts other customers or violates these rules.


9. Changes to this Agreement

Kuntokeskus Säterinportti may amend this Customer Agreement provided that the essential nature of the contractual relationship is not materially altered.

Customers will be notified of any changes by email and on the Gym’s website at least two months before the changes take effect.


10. Assignment

Kuntokeskus Säterinportti may assign this Agreement to another legal entity.

Customers may not assign or transfer this Agreement or any access rights to another person.


11. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of Finland.

Any disputes arising from this Agreement shall first be resolved through negotiations.

If no agreement can be reached, disputes shall be submitted to the District Court of Espoo, Finland.


12. Force Majeure

Kuntokeskus Säterinportti shall not be liable for failure to perform its obligations where such failure results from circumstances beyond its reasonable control, including but not limited to natural disasters, government actions, labour disputes, pandemics, interruptions to utilities or other force majeure events.

During such circumstances, the Gym shall not be obliged to refund membership fees or other payments relating to the affected period unless required by mandatory law.

MEMBERSHIP TERMS AND CONDITIONS

These Membership Terms and Conditions apply to all membership products offered by Kuntokeskus Säterinportti. By purchasing a membership, the customer agrees to these Terms and Conditions as well as the current Customer Agreement.


1. Membership Products

Kuntokeskus Säterinportti offers various memberships, passes and other fitness products. Product details, validity periods and prices are available on our website, online store and, where applicable, through our customer service.

A valid Customer Agreement is required before purchasing a membership.

Memberships are personal and may not be transferred to another person.


2. Commencement of Membership

A membership becomes effective once the customer has purchased the selected membership product and paid the first payment or agreed instalment.

The purchase becomes binding upon receipt of the first payment.


3. Membership Validity

Open-ended memberships remain valid until cancelled in accordance with these Terms and Conditions.

Fixed-term memberships remain valid for the agreed period and automatically continue as an open-ended membership unless cancelled in accordance with these Terms and Conditions.

During the summer season, group exercise classes may operate on a modified timetable. The gym remains open throughout the year.


4. Prices

Membership fees are charged according to the current price list.

Kuntokeskus Säterinportti reserves the right to amend its prices. Customers will be notified of any price changes by email and on the company’s website at least two months before the changes take effect.

Promotional prices apply only for the specified campaign period. After the promotional period ends, the membership will continue automatically at the standard price valid at that time.


5. Payments

Membership fees are charged according to the applicable billing schedule.

Billing is primarily carried out via e-invoice. If e-invoicing is unavailable or cannot be used due to reasons attributable to the customer, an alternative billing method will be used and an administration fee may be added in accordance with the current price list.

Customers are responsible for ensuring that their contact and billing information remains up to date.

Membership fees may also be paid in advance using payment methods accepted by Kuntokeskus Säterinportti. Payments made in advance are non-refundable unless otherwise required by mandatory law.


6. Initial Payment

The initial payment is determined according to the current price list.

The first payment may include:

  • joining fee
  • membership fee for the current billing period
  • membership fee for the next full billing period.

If the membership begins during an ongoing billing period, the first payment will be calculated on a pro-rata basis.


7. Membership Freeze

Standard-priced open-ended memberships may be frozen once per calendar year for either one (1) or two (2) months.

A freeze request must be submitted no later than the deadline specified before the requested freeze period begins.

Freezing a membership does not shorten the duration of a fixed-term agreement, and a membership cannot expire during a freeze period.

Promotional memberships and campaign products cannot be frozen unless otherwise stated.


8. Illness, Pregnancy and Military Service

Membership may be suspended due to long-term illness, injury, pregnancy, compulsory military service or another comparable reason.

The suspension requires an inability to exercise for at least one month.

Kuntokeskus Säterinportti may request supporting documentation, such as a medical certificate.

A suspension does not shorten the duration of a fixed-term membership.


9. Cancellation of an Open-Ended Membership

Open-ended memberships are subject to a one-calendar-month notice period.

Notice of cancellation must be submitted in writing by email or in person at the reception no later than the last day of the current calendar month.

The membership will end on the last day of the calendar month following the notice period.


10. Cancellation of a Fixed-Term Membership

Fixed-term memberships remain valid for the agreed contractual period.

If the customer does not wish the membership to continue as an open-ended membership after the fixed term, notice of cancellation must be submitted no later than the final calendar month of the fixed-term period.


11. Early Termination of a 12-Month Membership

A 12-month membership may also be terminated before the end of the agreed minimum term.

In such cases, the price difference between the discounted 12-month membership and the standard open-ended membership will be calculated for all months used, including the month in which the cancellation takes effect.

In addition, a €50 administration fee will be charged in accordance with the current price list.


12. Promotional Campaigns

Any special conditions relating to promotional offers or campaign prices are always published together with the offer in the online store or other marketing materials.

Unless otherwise stated, promotional memberships may be cancelled no earlier than during the first standard-priced billing period. The membership will end at the conclusion of the billing period following the notice of cancellation.

As a result, the customer will pay for at least two full standard-priced billing periods after the promotional period has ended.


13. Overdue Payments

If membership fees are not paid by the due date, Kuntokeskus Säterinportti reserves the right to suspend access to its facilities until all outstanding payments have been received.

Outstanding debts may be transferred to a collection agency in accordance with applicable legislation.

Repeated or substantial payment defaults may result in termination of both the membership and the Customer Agreement.


14. Changes to Services

Kuntokeskus Säterinportti continuously develops its services.

Equipment, group exercise classes, facilities, opening hours and other services may be modified from time to time.

Temporary interruptions caused by maintenance, repairs, renovations or service improvements do not entitle the customer to a price reduction or refund.


15. Governing Law

These Membership Terms and Conditions are governed by the laws of Finland.

In all other respects, the current Customer Agreement of Kuntokeskus Säterinportti shall apply.
